Liability & Insurance Terms
Last updated:
1. Platform Role
MOOVR is a technology platform that connects customers with independent third-party service providers (“Drivers” and “Helpers”) for moving, delivery, and logistics services. MOOVR is not a carrier, motor carrier, or freight forwarder, and does not itself transport goods.
2. Independent Carriers
All Drivers using the MOOVR platform operate as independent contractors and are solely responsible for the transportation, handling, and delivery of items. Drivers are required to maintain, at minimum:
- Valid commercial automobile insurance
- Applicable goods-in-transit (cargo) insurance
MOOVR may verify such documentation but does not guarantee the validity, sufficiency, or coverage of any Driver’s insurance policy.
3. Included Protection
Each booking may include limited base protection of up to $1,000 CAD per order, subject to eligibility, verification, and the terms outlined herein. This base protection:
- Applies only to qualifying claims
- Is not guaranteed and may be subject to review
- Does not replace carrier or third-party insurance
- Represents the maximum default protection where no additional coverage is selected
4. Declared Value & Additional Protection
Customers may increase the protection level of their items by purchasing additional coverage at the time of booking. Additional coverage:
- Is based on the declared value of the items
- May be provided by a third-party provider such as UPS Capital
- Is subject to the terms and conditions of that provider
Available coverage tiers may include (but are not limited to):
- $2,500 CAD
- $5,000 CAD
- $10,000 CAD
The selected coverage amount constitutes the maximum liability applicable to the booking.
5. Limitation of Liability
To the fullest extent permitted by law:
- Liability for any loss or damage is limited to the declared value selected at checkout
- If no additional coverage is selected, liability is capped at $1,000 CAD
MOOVR shall not be liable for:
- Indirect, incidental, or consequential damages
- Losses exceeding the declared value
- Items not disclosed or improperly described
- Damage resulting from insufficient or improper packaging
- Pre-existing damage
Nothing in this section limits liability where such limitation is prohibited by applicable law.
6. Claims Process
In the event of loss or damage:
- Claims must be submitted within 48 hours of delivery completion
- Customers may be required to provide photographic evidence, proof of value (receipts, invoices, etc.), and a description of the incident
Claims may be handled through:
- The Driver’s insurance provider
- A third-party coverage provider (if applicable)
- MOOVR support (as a facilitator only)
MOOVR does not guarantee claim approval or payout and is not the primary insurer.
7. Customer Responsibilities
Customers agree to:
- Accurately declare the value of all items
- Ensure items are properly packaged for transport
- Disclose any fragile, high-value, or unusual items
- Select appropriate coverage for their shipment value
Lifting Safety & Customer Responsibility
Drivers and Helpers on the MOOVR platform follow recognized safety standards. No individual shall lift items exceeding 50 pounds (23 kilograms) without assistance. Items exceeding this weight require additional help or customer assistance. Customers are responsible for arranging or providing such assistance where necessary. Failure to comply may result in reduced or denied claims.
8. Acknowledgment and Acceptance
By confirming a booking, the customer acknowledges and agrees that:
- They have been provided with the option to purchase additional protection
- They understand the included protection limit of $1,000 CAD
- They accept that liability is limited to the selected coverage amount
- They have accurately declared the value of their items
Summary of Liability & Coverage
The Carrier (Driver) is the primary party responsible for the transportation of goods and any associated loss or damage. Claims are first directed to the Carrier’s applicable insurance coverage.
MOOVR may provide limited base protection of up to $1,000 CAD per order, subject to eligibility, verification, and the terms of the platform. This protection is not guaranteed and does not replace carrier or third-party insurance.
Where additional declared-value coverage has been purchased (e.g., through UPS Capital), such coverage applies in accordance with its own terms and conditions and may provide additional protection up to the declared value.
This layered structure reflects standard industry practice, where primary responsibility rests with the Carrier, and additional protections may apply subject to eligibility and coverage terms.
